North America Construction's Dispute with Utilities Kingdom
Goodmans LLP is acting for North America Construction (“NAC”) in its lawsuit against Utilities Kingdom where NAC claims Utilities Kingston owes it and its workers $29 million after its contract was cancelled in the summer.
NAC was hired by Utilities Kingston to expand a sewage treatment plant in Kingston, Ontario.
The claim involves termination for convenience, payment of contract funds and issues surrounding additional cost claims. In addition to the main action by NAC, there are numerous additional claims being asserted by various subcontractors in respect of the project. There is also a counterclaim being asserted by Utilities Kingston against NAC.
