Trademark Prosecution, Licensing and Transactions
We offer clients highly bespoke strategies for building and managing trademark portfolios and avoiding the trademark rights of others, including their competitors.
Our clients are diverse – they represent an array of industries and have unique needs. Our lawyers take time to clearly understand how each client’s trademarks fit within their Canadian business as well as their global goals. This understanding informs our advice to clients in protecting, registering, transacting with, and managing their trademarks.
We assist clients in obtaining and maintaining trademarks through prosecution before the Canadian Intellectual Property Office and through an established network of foreign counsel securing rights in other countries.
We are routinely involved in opposition and summary expungement proceedings before the Canadian Intellectual Property Office and actions before the Federal Court of Canada. We also help clients in developing and instituting appropriate usage policies, establishing effective strategies for the protection, defence and enforcement of their trademarks, and exploiting their rights through licensing and other forms of agreements.
Our trademark lawyers regularly engage in transactional work, including conducting due diligence, reviewing and drafting transaction and related documents, preparing licence and other agreements, transferring trademarks, and recording security interests and releases. They are consistently recognized and recommended by leading industry publications.
