Technology Disputes
Technology is embedded in almost every business and when disputes related to technology arise they are often complex and of strategic importance. We act for multi-national suppliers of technology, Canadian innovative disrupters, enterprises using technology and technology service providers. We have handled some of Canada’s highest value technology disputes and technology first-time issues, bringing our creativity to every mandate.
Disputes about technology or business disputes in the technology context have a unique cadence, with strategic implications for our clients. They require an understanding of technology sectors, the prevailing jargon and the relevant regulatory environment. Importantly, technology disputes often cross traditional legal boundaries, requiring a mix of experience with sophisticated contract law principles, intellectual property concepts and statutory torts. It is also a highly internationalized field.
Goodmans has a holistic and highly effective approach to technology disputes: As the situation warrants, we deploy members of the firm’s litigation and dispute resolution, technology transaction and intellectual property groups to reach the client’s objective. Actively seeking creative business solutions, aggressively pursuing litigation or arbitration, and seamlessly applying both approaches simultaneously is our hallmark. We do not start at ground zero when taking on a technology dispute – because we have a practice focused on such disputes, we are well up the curve on day one.
We have acted as technology litigation or arbitration counsel for companies such as Oracle, SAP, Software AG, Ceridian, Trader Corp, the Business Development Bank of Canada and Bell Media, handling some of their most difficult disputes. Our lawyers have held leadership positions in the International Technology Law Association, Canadian Technology Law Association and Silicon Valley Arbitration & Mediation Center. We are recognized as leaders in every major ranking of technology dispute lawyers and founded Canada’s Technology Law Discussion Forum, putting us at the centre of the domestic technology bar.
