As class actions have proliferated in Canada, Goodmans has been at the forefront of class action defence. We have represented clients in over 50 discrete class action matters and were counsel in the first Canadian securities class action to proceed to trial.
Our class action lawyers have appeared before trial and appellate courts across the country and on numerous occasions before the Supreme Court of Canada. Our litigators are skilled in areas including collusion and price fixing, securities, financial services, and product liability. From preliminary motions to certification and right through trial and appeals, you can expect us to be fearless in defending the interests of our clients.
Litigation distracts from our clients’ daily operations, consuming time and resources that would otherwise be used to advance their core business. Class actions, because of their complexity and potential financial impact, can only exacerbate that distraction. We are judicious in the use of client resources and work to minimize the impacts of litigation on their business at every step of a proceeding. We respect our clients’ time, providing prompt drafts and succinct updates and communicating in the manner, and at the times, most convenient for them. We work for our clients, not the other way around.
We advocate for our clients at every opportunity, not just the obvious ones, constantly striving to shape the narrative to best position our clients’ case. Our class action litigators provide not only a deep understanding of the law, but the ability to articulate it in a persuasive and effective manner both in court and with opposing counsel. We have the experience to know when to escalate an issue and the courage and judgment to know when a more subtle approach is required. We recognize that most class actions are resolved by way of settlement and at all stages of a proceeding we zealously pursue our clients’ objectives while continually evaluating risks, expenses and options. Goodmans works with clients and their insurers to design litigation strategies and manage exposures to protect their best interests.
Goodmans often acts as national coordinating counsel for Canada wide class actions, and routinely coordinates strategy and approach with foreign counsel where our clients are involved in similar proceedings outside of Canada.
